1. The premium you pay a bondsman
The premium is the bondsman’s fee, up to 15 percent of the bond amount. It goes to the bail agency and, in part, to the insurance company that backs the bond. It pays for the risk of guaranteeing the full amount, the agent’s time at the jail, monitoring the case, and the company’s licensing and bonding costs.

2. A cash bond paid directly to the court
If a family pays the full bond amount in cash to the clerk of court instead of using a bondsman, that money is held by the court for the life of the case.
- If the person makes every court date, the cash is returned at the end, minus any fines, fees or restitution the court applies. Refunds typically take weeks after the case closes.
- If the person misses court, the court can forfeit the cash. It then goes to the county school fund, which is where forfeited bonds go in North Carolina.
3. Collateral held by a bondsman
On larger bonds a bondsman may hold collateral: a vehicle title, a deed, or cash in trust. Collateral is not a fee. It is security in case the bond is forfeited.

Where forfeited bond money goes
North Carolina directs forfeited bail bonds to the public schools of the county where the case was heard. That is true whether the bond was cash or surety. It is one reason courts take failures to appear seriously and one reason bondsmen work hard to prevent them.
