What the court does
Order for arrest
When a defendant does not appear, the judge issues an order for arrest (OFA) for failure to appear. Any officer can serve it, including at a traffic stop. Many OFAs come with a new, higher bond.
Order for arrest
License consequences. For traffic and some other cases, the clerk notifies the DMV, which can suspend the driver's license until the case is resolved.
Bond forfeiture notice.
If the person was out on a bond, the clerk enters a forfeiture and mails notice to the defendant and the bondsman. The forfeiture becomes final after 150 days unless it is set aside.
What the bondsman does
The bondsman now has a strong incentive to get the defendant back before the court. During the 150-day window the forfeiture can be set aside if the defendant is returned to custody, appears in court and the order is recalled, or certain other conditions are met. Champion will:
- Contact the defendant and the co-signer immediately.
- Explain the fastest way to resolve the OFA, usually appearing in court with counsel or surrendering with a pre-arranged new bond. Warrant search
- Coordinate with the attorney on a motion to recall the order and reinstate the original bond, where the judge allows it.
- In extreme cases, locate and surrender the defendant to the jail so the forfeiture can be set aside.
Once the forfeiture is set aside, the co-signer’s liability for the full bond is cleared.
Call us.
We check the docket and confirm whether an OFA has issued and what bond is attached.
Call the attorney
Call the attorney, or let us refer one. Many missed dates come from a notice sent to an old address or a genuine mix-up; an attorney can often get the OFA recalled and the date reset with a single motion
Do not wait for a traffic stop.
A planned surrender on a weekday morning with a bond already arranged means hours in custody. An arrest on a Friday night means a weekend.
Keep every new date.
After a failure to appear, judges are far less patient with a second one.
What it costs
If the original bond is reinstated, no new premium is owed. If the court sets a new, higher bond after the FTA, a new bond and premium are required. The co-signer remains liable on the original bond until the forfeiture is set aside. Where does bail bond money go
